Terms of Use for the "Tati" Application

Copyrights on the "Tati" Application
The copyright for the "Tati" application belongs to LLC Pau Group. Any rights related to the "Tati" application, its use, and operation, including any content such as audio, video, photos, and images (including those containing representations of "users" and "partners"), are the exclusive property of the Company.

The use of the "Tati" application by "users" or "partners" does not grant the right to reference the Company's name, logo, product or service names, or trademarks in any way when offering, ordering, or providing services unless prior written consent from the Company is obtained.

As a "user" or "partner," you are not allowed to:

a) Reproduce the software application, in whole or in part, by any means or in any form.

b) Translate, adapt, systematize, or otherwise modify the software application, or reproduce the results obtained from such modifications.

c) Create derivative works using the software application, transfer, license, publicly display, or otherwise infringe upon the Company's copyright for the "Tati" application.

d) Copy data, create databases based on the data, or perform any unauthorized and unsanctioned actions on the software.

Responsibilities of the Parties
By agreeing to the "Terms and Conditions of Use," both "users" and "partners" acknowledge that the Company does not act as the provider or executor of the "services" ordered through the "Tati platform" by "users." Accordingly, the Company is not responsible for:

  • Delays in the performance of the "services."
  • Improper or incomplete performance of the "services."
  • Refusal or partial reimbursement of "service fees."
  • Damage to property caused by the "partner" while providing the "service" to the "user" or third parties.
  • Determination and payment of taxes arising from services provided by the "partner."

All responsibilities related to the services rest solely with the "partner" or the "user." Disputes between the "user" and "partner" regarding services are governed by their agreement (oral or written) and applicable legislation.

In case of non-compliance with the purposes, principles, obligations, or prohibitions outlined in these "Terms and Conditions," the "user" and/or "partner" shall be fully liable for any direct, indirect, consequential, reputational, or other damages caused to the Company as per Georgian law.

Amendments to the Terms and Conditions of Use
The Company reserves the right to unilaterally make periodic changes or additions to the "Terms and Conditions of Use" without obtaining additional consent from "users" or "partners." Such changes become effective once published on the "Tati" application.

The Company may, but is not obligated to, notify "users" and "partners" of changes via its communication channels, including its website, email, or other available means.

Continued use of the "Tati platform" by "users" and "partners" after such changes or additions are published constitutes acceptance of the respective changes.

Personal Data Processing
Personal information collected from "users" or "partners" by the Company is processed in accordance with the personal data processing and protection policy outlined in these terms.

By registering on the "Tati" application, you consent to the Company's right to process your personal data for legally permitted purposes, including advertising. This may include sending promotional SMS messages or emails.

The transfer of "user" or "partner" personal data to third parties for purposes other than those specified herein is permitted only in cases provided by law, based on a competent authority's request (e.g., court order).

"Users" and "partners" agree that for the purpose of providing effective services, the Company may collect, verify, and process any personal information provided during account creation until the termination of the agreement.

Other Provisions
The performance location for obligations arising from these "Terms and Conditions" is Tbilisi, Georgia.

If any section or part of these "Terms and Conditions" is deemed invalid or void under applicable law, it shall be considered non-existent, while all other provisions shall remain in force.

These "Terms and Conditions" are governed by and interpreted in accordance with the laws of Georgia.

Any disputes or disagreements arising in relation to these "Terms and Conditions" shall be resolved through negotiations between the parties. If no agreement is reached, the parties may refer the matter to the courts, without waiving the right to pursue settlement before initiating legal proceedings.
